are often criticized for treating colleges as if they were factories: 
using models that evaluate college efficiency in creating outputs 
(student completions) for a given input (cost).
In fact, in many ways a college education is like the factory 
production process: students start at the beginning and then, after a 
sequence of &amp;ldquo;inputs&amp;rdquo; in the form of courses and support services, some 
graduate successfully at the end. Unfortunately, economic analyses of college efficiency typically do 
not look at college as a process. Economic models have traditionally 
tried to understand college efficiency through a simple input-per-output

Je doute m&amp;ecirc;me qu&amp;rsquo;elles &amp;laquo; instaurent une gouvernance plus efficace, plus d&amp;eacute;mocratique et plus coll&amp;eacute;giale &amp;raquo;, comme le souhaite le d&amp;eacute;put&amp;eacute; de Lorraine.&lt;br /&gt;
En mati&amp;egrave;re de gouvernance, les universit&amp;eacute;s auront moins d&amp;rsquo;autonomie. Dans l&amp;rsquo;application du principe tant vant&amp;eacute; de &amp;laquo; subsidiarit&amp;eacute; &amp;raquo;, l&amp;rsquo;&amp;Eacute;tat reprend des pr&amp;eacute;rogatives (cf. chronique &amp;agrave; venir sur la composition des conseils centraux). Un exemple, c&amp;rsquo;est le recteur d&amp;rsquo;Acad&amp;eacute;mie qui nommera les personnalit&amp;eacute;s ext&amp;eacute;rieures du Conseil d&amp;rsquo;administration (article 712-3 modifi&amp;eacute;, page 19). Ces personnalit&amp;eacute;s participeront d&amp;eacute;sormais &amp;agrave; l&amp;rsquo;&amp;eacute;lection du pr&amp;eacute;sident.&lt;br /&gt;
&lt;strong&gt;1. Le pr&amp;eacute;sident.&lt;/strong&gt; Un seul mandat de cinq ans au lieu d&amp;rsquo;un mandat de quatre ans renouvelable une fois. C&amp;rsquo;est un retour &amp;agrave; la loi de 1984. Pourquoi? Si la loi Fioraso s&amp;rsquo;applique d&amp;egrave;s 2014 et si des &amp;eacute;lections aux conseils centraux s&amp;rsquo;ensuivent, comme en 2008 apr&amp;egrave;s la publication de la loi LRU en 2007, que deviendront les pr&amp;eacute;sidents qui exercent aujourd&amp;rsquo;hui un second mandat? Il serait logique qu&amp;rsquo;ils ne puissent &amp;ecirc;tre &amp;laquo; confirm&amp;eacute;s &amp;raquo; dans leurs fonctions car ils auront alors &amp;laquo; fait le pr&amp;eacute;sident &amp;raquo; pendant 6 ans (4 + 2). Exeunt en 2014 les pr&amp;eacute;sidents r&amp;eacute;&amp;eacute;lus en 2012?&lt;br /&gt;
&lt;strong&gt;2. Deux conseils centraux&lt;/strong&gt; (conseil d&amp;rsquo;administration et conseil acad&amp;eacute;mique) au lieu de trois (CA, CS, CEVU). Pourquoi? Pour faire mieux interagir la recherche, la formation et la vie &amp;eacute;tudiante? Hypoth&amp;egrave;se hardie!&lt;br /&gt;
&lt;strong&gt;3. Comp&amp;eacute;tences des deux Conseils et du Pr&amp;eacute;sident&lt;/strong&gt; (article L 721-1 modifi&amp;eacute;). &amp;laquo; Le pr&amp;eacute;sident de l&amp;rsquo;universit&amp;eacute; par ses d&amp;eacute;cisions, le conseil d&amp;rsquo;administration par ses d&amp;eacute;lib&amp;eacute;rations et le conseil acad&amp;eacute;mique, par ses d&amp;eacute;lib&amp;eacute;rations et avis, assurent l&amp;rsquo;administration de l&amp;rsquo;universit&amp;eacute; &amp;raquo; (page 16). Le projet de loi semble donc suivre le rapport Le D&amp;eacute;aut: celui-ci propose en effet de doter le CS et le CEVU de comp&amp;eacute;tences d&amp;eacute;lib&amp;eacute;ratives dans le champ de leurs missions, et pr&amp;eacute;voit un m&amp;eacute;canisme de conciliation en cas de d&amp;eacute;cisions du CS et du CEVU que le CA estimerait incompatibles avec la strat&amp;eacute;gie ou le budget de l&amp;rsquo;universit&amp;eacute;.&lt;br /&gt;
Mais les articles suivants sont beaucoup moins clairs (article&amp;nbsp; L 719.2) car les verbes utilis&amp;eacute;s sont flottants. Le Conseil d&amp;rsquo;administration &amp;laquo; approuve &amp;raquo;, &amp;laquo; vote &amp;raquo;, &amp;laquo; adopte &amp;raquo;, &amp;laquo; fixe &amp;raquo;, &amp;laquo; autorise &amp;raquo;, &amp;laquo; d&amp;eacute;lib&amp;egrave;re &amp;raquo;, &amp;laquo; peut d&amp;eacute;l&amp;eacute;guer au pr&amp;eacute;sident &amp;raquo;. Le Conseil acad&amp;eacute;mique &amp;laquo; adopte &amp;raquo;, &amp;laquo; donne un avis &amp;raquo;, &amp;laquo; est consult&amp;eacute; et peut &amp;eacute;mettre des v&amp;oelig;ux &amp;raquo;. Des conflits de comp&amp;eacute;tences entre le CA et le CA sont pr&amp;eacute;visibles. Le projet de loi ne pr&amp;eacute;voit pas d&amp;rsquo;instance de conciliation!&lt;br /&gt;
Le projet de loi (article 712-4 modifi&amp;eacute;, page 22) pr&amp;eacute;voit que &amp;laquo; le conseil acad&amp;eacute;mique adopte les r&amp;egrave;gles relatives aux examens &amp;raquo;, pr&amp;eacute;rogative actuellement du conseil d&amp;rsquo;administration. Il pourrait donc d&amp;eacute;cider de modalit&amp;eacute;s de contr&amp;ocirc;le des connaissances encore plus laxistes que celles instaur&amp;eacute;es par l&amp;rsquo;arr&amp;ecirc;t&amp;eacute; Wauquiez d&amp;rsquo;ao&amp;ucirc;t 2011. Le risque d&amp;rsquo;un laxisme accru n&amp;rsquo;est pas nul: en effet, les &amp;eacute;tudiants et les doctorants constitueraient de 35 &amp;agrave; 45% des membres &amp;eacute;lus de ce conseil.&lt;strong&gt;&lt;br /&gt;
4. D&amp;eacute;l&amp;eacute;gations de comp&amp;eacute;tences:&lt;/strong&gt; elles vont dans toutes les directions, bref une subsidiarit&amp;eacute; &amp;agrave; g&amp;eacute;om&amp;eacute;trie variable, remontante ou descendante. Du conseil d&amp;rsquo;administration vers les directeurs de composantes ou le conseil acad&amp;eacute;mique pour la nomination des diff&amp;eacute;rents jurys (page 18). Du Conseil d&amp;rsquo;administration vers la pr&amp;eacute;sidence (page 21): &amp;laquo; Le Conseil d&amp;rsquo;administration peut d&amp;eacute;l&amp;eacute;guer au pr&amp;eacute;sident le pouvoir d&amp;rsquo;adopter les d&amp;eacute;cisions modificatives du budget &amp;raquo;. Le pr&amp;eacute;sident aurait alors une pr&amp;eacute;rogative financi&amp;egrave;re &amp;eacute;norme, gage d&amp;rsquo;un renforcement de son pouvoir. Du conseil acad&amp;eacute;mique vers une de ses sections&amp;hellip;&lt;strong&gt;&lt;br /&gt;
5. Multiplication du nombre d&amp;rsquo;instances.&lt;/strong&gt; Conseil acad&amp;eacute;mique en formation restreinte aux enseignants-chercheurs: &amp;laquo; il est l&amp;rsquo;organe comp&amp;eacute;tent pour l&amp;rsquo;examen des questions individuelles relatives au recrutement, &amp;agrave; l&amp;rsquo;affectation, et &amp;agrave; la carri&amp;egrave;res des enseignants-chercheurs et personnels assimil&amp;eacute;s &amp;raquo;&amp;hellip; Plus loin: il ne fait que donner son avis sur les mutations des enseignants-chercheurs! Allez comprendre! Qui va d&amp;eacute;cider le nombre, l&amp;rsquo;affectation et le montant des primes d&amp;rsquo;excellence scientifique? Le CA ou le CA ?&lt;br /&gt;
Cr&amp;eacute;ation de sections au sein du Conseil acad&amp;eacute;mique. &amp;laquo; Outre la section disciplinaire (L 712-5 modifi&amp;eacute;), les statuts de l&amp;rsquo;universit&amp;eacute; peuvent pr&amp;eacute;voir la mise en place de sections au sein du conseil acad&amp;eacute;mique. Ils pr&amp;eacute;cisent leurs compositions et leurs comp&amp;eacute;tences respectives ainsi que les d&amp;eacute;l&amp;eacute;gations de comp&amp;eacute;tence du conseil aux sections &amp;raquo; (page 24). L&amp;rsquo;article est fort cocasse: les statuts de l&amp;rsquo;universit&amp;eacute; pourront donc cr&amp;eacute;er deux sections au sein du conseil acad&amp;eacute;mique, qui seraient d&amp;eacute;nomm&amp;eacute;es &amp;laquo; conseil scientifique &amp;raquo; et &amp;laquo; conseil des &amp;eacute;tudes et de la vie universitaire &amp;raquo;. Vous avez dit &amp;laquo; simplification du millefeuille institutionnel &amp;raquo;?&lt;strong&gt;&lt;br /&gt;
6. Un conseil des directeurs de composantes peut &amp;ecirc;tre pr&amp;eacute;vu par les statuts&lt;/strong&gt; (article 713-1 modifi&amp;eacute;): &amp;laquo; le pr&amp;eacute;sident associe les composantes &amp;agrave; la pr&amp;eacute;paration et &amp;agrave; la mise en &amp;oelig;uvre du contrat pluriannuel d&amp;rsquo;&amp;eacute;tablissement &amp;raquo;. Autre repr&amp;eacute;sentation des composantes par une autre voie que le conseil des directeurs : &amp;laquo; le conseil acad&amp;eacute;mique comprend, pour un quart de ses membres, des repr&amp;eacute;sentants des composantes de l&amp;rsquo;universit&amp;eacute; d&amp;eacute;sign&amp;eacute;s au sein de leurs conseils, selon des modalit&amp;eacute;s fix&amp;eacute;es par les statuts de l&amp;rsquo;universit&amp;eacute; &amp;raquo; (article L 712-4, page 22). Cette double voie de repr&amp;eacute;sentation des composantes est-elle le moyen d&amp;rsquo;une coll&amp;eacute;gialit&amp;eacute; accrue ou une proposition &amp;laquo; petit bras &amp;raquo;!&lt;br /&gt;

l&#039;acte. Le Premier ministre, Jean-Marc Ayrault, ouvre ce matin les 
Assises nationales de l&#039;enseignement sup&amp;eacute;rieur et de la recherche (voir 
ci-contre). La r&amp;eacute;forme de la gouvernance des universit&amp;eacute;s est un sujet 
phare de ces assises.  &lt;em&gt;&amp;laquo;&amp;nbsp;On a pr&amp;egrave;s de 200 &amp;eacute;tablissements d&#039;enseignement sup&amp;eacute;rieur (universit&amp;eacute;s et grandes &amp;eacute;coles) qui n&#039;ont pas la taille critique, &lt;/em&gt;regrette une source officielle qui plaide pour leur rapprochement.  &lt;em&gt;On
n&#039;aura pas des fusions partout et l&#039;organisation en p&amp;ocirc;les 
d&#039;enseignement sup&amp;eacute;rieur et de recherche (PRES) est bien insuffisante. &lt;strong&gt;
L&#039;architecture de l&#039;universit&amp;eacute; est baroque&lt;/strong&gt; et donc &amp;agrave; revoir.&amp;nbsp;&amp;raquo;&lt;/em&gt; La 
r&amp;eacute;forme attendue aura un impact direct sur le rapprochement entre 
universit&amp;eacute;s et entreprises que le gouvernement veut favoriser.  &lt;em&gt;&amp;laquo;&amp;nbsp;Il
faut simplifier la gouvernance pour que les entrepreneurs y voient plus
clair, il faut ouvrir les universit&amp;eacute;s aux entreprises et ces derni&amp;egrave;res 
doivent entendre les universit&amp;eacute;s&amp;nbsp;pour un v&amp;eacute;ritable rapprochement&amp;nbsp;&amp;raquo;,&lt;/em&gt; plaide Genevi&amp;egrave;ve Fioraso.
